Therapist Terms of Use

These Therapist Terms of Use ("Terms") govern the relationship between Mindful Holdings Ltd ("Mindful UK", "we", "us") and any therapist, counsellor, psychologist, or wellbeing professional ("Therapist", "you") who registers or is listed on the Mindful UK platform ("Platform").
By creating a profile or being listed on the Platform, you agree to be bound by these Terms. Please read them carefully.
1. Platform Role
Mindful UK operates as an introductory platform only. We connect clients with independent therapists. We do not employ, manage, supervise, or represent any therapist listed on the Platform.
You operate as an independent professional. Mindful UK is not your employer, agent, or representative and has no authority over your clinical practice.
2. Eligibility
To be listed on the Mindful UK platform, you must:
- Hold relevant qualifications appropriate to the services you offer.
- Maintain membership of a recognised professional body where applicable (e.g. BACP, UKCP, BPS, COSCA).
- Hold valid professional indemnity insurance at all times.
- Be legally entitled to practice in the United Kingdom.
- Comply with all applicable laws, regulations, and professional standards.
3. Your Responsibilities
As a therapist listed on Mindful UK, you are solely responsible for:
- The therapeutic services you provide to clients.
- Maintaining up-to-date professional qualifications and registrations.
- Keeping your professional indemnity insurance valid and current.
- Managing client records in accordance with applicable data protection laws, including UK GDPR.
- Maintaining client confidentiality and complying with safeguarding obligations.
- Setting, communicating, and collecting your own fees directly with clients.
- Complying with the ethical frameworks of your relevant professional body.
- Ensuring your practice is safe, ethical, and of an appropriate professional standard.
4. Accuracy of Information
You agree to provide accurate, truthful, and up-to-date information in your profile, including qualifications, memberships, insurance status, specialisms, and availability. Providing false or misleading information may result in immediate removal from the Platform.
5. Client Relationships
Any therapeutic relationship you enter into is solely between you and the client. Mindful UK is not a party to any therapy agreement, treatment plan, or clinical decision.
You are responsible for obtaining appropriate consent from clients, including for data processing and treatment.
6. Safeguarding
You agree to maintain and follow appropriate safeguarding policies and procedures relevant to your practice. In situations involving risk to life or welfare, you must follow your professional safeguarding obligations and, where required, report concerns to the relevant authorities.
7. Fees and Payments
All fee arrangements are made directly between you and your clients. Mindful UK is not responsible for the collection, management, or recovery of any fees. Any financial disputes between you and a client are a matter solely between you and the client.
8. Complaints
In the event of a complaint from a client, you are expected to handle complaints professionally and in accordance with your professional body's complaints procedure. Mindful UK cannot mediate or arbitrate disputes between therapists and clients.
Complaints relating to your professional conduct may be escalated by clients to your relevant professional body or regulator.
9. Removal from the Platform
Mindful UK reserves the right to remove a therapist from the Platform at any time, including if:
- False or misleading information is provided.
- Professional registration or insurance lapses.
- Serious complaints or concerns are raised.
- These Terms are breached.
- We determine, at our sole discretion, that removal is in the interests of platform users.
10. Data Protection
You agree to comply with UK GDPR and the Data Protection Act 2018 in relation to any personal data you process in connection with clients introduced through the Mindful UK Platform.
You are an independent data controller in respect of client data you process. Mindful UK is not responsible for your data processing activities.
11. Limitation of Liability
To the fullest extent permitted by law, Mindful UK shall not be liable for any claims, losses, damages, or costs arising from the services you provide to clients. You agree to indemnify Mindful UK against any claims arising from your professional practice.
12. Changes to These Terms
Mindful UK may update these Terms from time to time. Continued listing on the Platform following notification of changes constitutes acceptance of the revised Terms.
13. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
