Please read these Terms carefully before using Mindful. By accessing or using our platform, you agree to be bound by these Terms.

Mindful is a mental health and wellbeing support tool. It is NOT a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider with any questions about your mental health. 1. Acceptance of Terms
By creating an account or using the Mindful platform ("Service"), you confirm that you are at least 18 years of age, have read and understood these Terms of Service, and agree to be bound by them. If you do not agree, please do not use the Service.
2. Description of Service
Mindful provides a digital mental health and wellbeing platform including, but not limited to:
- AI-powered chat and emotional support tools
- Mood, sleep, trigger, and stress tracking
- Guided meditation and wellness programmes
- Journaling and voice journaling features
- Medication reminders and health tracking
- Crisis resources and safety planning tools
- Manager resources for workplace wellbeing
3. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must:
- Provide accurate and complete registration information.
- Keep your password secure and not share it with others.
- Notify us immediately of any unauthorised use of your account.
- Not create accounts for others without their consent.
4. Subscriptions and Payments
Payments are processed securely by Stripe. We do not store your payment card details.
- Subscription fees are billed in advance on a monthly or annual basis.
- You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
- We do not offer refunds for partial subscription periods, except where required by law.
- We reserve the right to change pricing with 30 days' notice to existing subscribers.
- Family plans cover up to the number of users stated at the time of purchase.
5. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law or regulation.
- Harass, abuse, or harm others.
- Attempt to gain unauthorised access to any part of the platform.
- Reverse-engineer, scrape, or copy any part of the Service.
- Upload malicious code or interfere with the platform's operation.
- Share your account credentials with others.
6. Health and Wellbeing Data
Your health data belongs to you. We process it solely to provide the Service and will never sell it or use it for advertising.
By using health tracking features, you explicitly consent to us processing your Special Category health data under UK GDPR Article 9(2)(a). You can withdraw consent and request deletion of your health data at any time by contacting us or deleting your account.
7. AI Features and Limitations
Our AI tools are designed to provide support and information, not clinical advice. Please be aware:
- AI responses are generated automatically and may not always be accurate or appropriate.
- Do not rely on AI chat as a substitute for professional mental health care.
- In a mental health emergency, always contact emergency services or a qualified professional.
- AI conversations may be reviewed for safety and quality improvement purposes.
8. Intellectual Property
All content, features, and functionality of the Mindful platform (including text, graphics, logos, and software) are owned by Mindful and are protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission. Content you create (such as journal entries) remains yours.
9. Limitation of Liability
To the fullest extent permitted by law, Mindful shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability to you for any claims arising from these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim. Nothing in these Terms limits liability for death, personal injury, or fraud caused by our negligence.
10. Termination
We reserve the right to suspend or terminate your account if you breach these Terms. You may close your account at any time from your account settings. Upon termination, your right to use the Service ceases immediately, and we will handle your data in accordance with our Privacy Policy.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
12. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or through a notice on the platform at least 14 days before the changes take effect. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
